Les éléments de l'acte juridique constituent les exigences de fond et de telle manière que le système juridique établit comme facteurs conditionnels de son existence et de sa validité.
L'acte juridique est la manifestation unilatérale et plurilatérale, volontaire et consciente faite dans l'intention de créer, transférer, modifier ou éteindre des droits et obligations.
Pour que cette manifestation de volonté prenne pleinement effet, elle doit être réalisée conformément aux dispositions légales établies dans l'ordre juridique applicable.
Ces dispositions sont les éléments constitutifs des actes juridiques, qui doivent concorder et être intégrés en tant que condition exclusive de l'existence, de la reconnaissance et de la production d'effets juridiques.
Les 3 principaux éléments de l'acte juridique
1- Essentiel
Ce sont ceux qui doivent être présents pour que l'acte soit considéré comme existant et valide.
L'absence de tout élément essentiel ou d'existence affecte l'acte juridique en question, au point qu'il ne peut avoir aucun effet. Les éléments essentiels sont l'existence et la validité
De l'existence
Ce sont ceux qui, s'ils ne sont pas présents et intégrés, conduisent à la nullité absolue de l'acte. Par exemple:
- La volonté et le consentement exprimés librement et consciemment.
- Le ou les sujets, également appelés parties, qui sont les personnes physiques ou morales qui accomplissent l'acte.
- L'objet, se référant à ce que les parties conviennent de livrer ou de faire.
- La cause ou l'action génératrice, comprise comme la fin souhaitée par les parties.
- La formalité; c'est-à-dire les solennités qui, selon la loi, doivent accompagner la manifestation de la volonté des parties.
Validité
Ces exigences n'empêchent pas la configuration de l'acte. Cependant, son omission peut la rendre annulable. Par exemple:
- La volonté libre de vices.
- L'objet et la cause juridiques et possibles. L'acte juridique dont l'objet est la commission d'un crime n'a pas de validité en raison de l'illégalité de son objet.
- La capacité, se référant à la capacité des parties d'acquérir, de jouir et d'exercer un droit.
2- Naturel
Ce sont ceux que la législation attribue à chaque activité juridique spécifique. Compte tenu de la nature de l'acte, ces éléments existent toujours même si les parties ne les intègrent pas ou n'en tiennent pas compte.
Par exemple:
- Le droit de préférence en cas d'héritages, de communautés et d'associations.
- La garantie d'expulsion (perte d'un droit) en raison de vices matériels de l'objet et de l'assainissement de la loi.
- Intérêts, lorsqu'il s'agit d'emprunter de l'argent.
3- accidentel
Les éléments accidentels sont expressément incorporés par la volonté des parties. Sa détermination n'affecte pas l'existence et la validité de l'acte juridique, à condition que son essence ne soit pas dénaturée ou qu'aucune disposition légale ne soit violée.

État
C'est un événement futur et incertain dont dépend la naissance (condition suspensive) ou l'extinction d'un droit (condition résolutoire).
Terme
C'est un événement futur et certain dont dépend la force exécutoire ou l'extinction d'un droit.
Mode
Représente une obligation accessoire qui doit être exécutée par l'acquéreur d'un droit.
